Every week I take time to do some research so that I can be on top of the immigration updates, and why not?
Attorneys have absolutely no clue about the problems and despair we are going thru. They drag heels on simple processing and documentation work, oblivious to the fact that even a single day just adds to our woes.
I need to plan more than 6 months in advance for any major change in my life , be it marriage, having a baby, investing in property - u name it. Every single life event has a big question mark after it. Will I get the visa stamped? Will I be able to extend status? Can I do this, Can I do that? Well I guess life has an immigrant in the US (legal or illegal) has a question mark ?
I am going thru this frustrating non-ending wait to get anywhere close to permanent residency. I had filed for labor - Then came the DOL overhaul, where labor certification decisions are rolled out in the most haphazard, and random fashion one can ever imagine. Unable to wait any longer I even quit the company that filed my LC and joined another company
I am waiting for the new co to file a new LC under PERM - Again I need to wait as LCs can't be filed immediately for new hires - Even finding a co that can provide immigration benefits along with other personal benefits becomes a challenge.
Now I wish my old LC never gets approved - It remains pending for a few more years - at least I can get incremental h1b extensions. (thanks to the AC21 silver lining)
I just have another year left on my H1. I have worked for over 5 years legally, never going out of status, paying all taxes.
My spouse even gave up the idea of working here legally. The long wait for immigration benefits is now a part of my life - All I can do is pray that our senators when going for recess while discussing immigration; get some thought into their heads abt the nightmare that legal immigrants go thru....

Thanks for all the responses and suggestion. All your suggestions mean one thing my filling the H1 this year is near to impossible. well i understand the situatiuon and now i'm in a state to plan my moves.
Firstly can i take my OPT back and continue my current masters?? I sent the forms on say 1st of April..
Sencond, Is this an option that i file my H1 with some firm next year (2008) and after my opt expires join for a Masters/PHD course get a F1 status so that i can stay in the US, then when my H1 comes to act on Oct 2008 can i take that and withdraw from the Masters program and also change from F1 to H1??? Is this possible coz this is what i might plan to do.....

Guys, by all means this discussion is itself is like find no mans land.
I think we should unite among ourselves rather than talking about all these circumstances. Yes I agree with Ganguteli... People got their labor subsituted because they had a oppurtunity and a provision that was legally correct. Instead of sitting and cribbing lets look in a direction which is going to unite all these streams into a big force.
Com'on guys, stop looking at things from a closed prespective. We need to be open and look at a grand agenda.

Didnt USCIS issue a Memo or something stating only one h1B filing per person?

See new 8 CFR 214.2(h)(2)(i)(G). This preclusion applies even if the petitions are not duplicative.
USCIS recognizes that, by statute, multiple filings of H-1B petitions are contemplated. See INA sec. 214(g)(7), 8 U.S.C. 1184(g)(7). Nevertheless, USCIS finds that this rule�s preclusion of duplicative H-1B filings is consistent with the statute. when I went for the interview, I have truck load of documents..everyone was looking wierd at us..
They didnt check any Tax returns, bank statements..BUT DO TAKE THEM.
may be she didnt check them because I had a big bump around filing date.

Even if you assume there are 3000-5000 labor subs that chocks up the queue, it might have benefited the ones with a 2003 PD like yourself. But for others (beyond 2003) , it is not much of a help. A visa recapture would benefit the community at large.
Even if you consider 3000-5000 labor subs, not many of those are "sold" labors, many of them are legal ones. labor subs were all legal until some companies started selling those.

Prior to July 2007, the law & regulations allowed to utilize the labor cert, that was certified for a Alien with a diff Alien, provided skill, edu... etc matches. Though it is legal, the amount of mis-use led to sunset of the program after many many years of existence.
My argument is that Labor Sub, does impact PD movement significantly, Also most people I know with PD prior to 2002 , except very few unlucky ones most got their GC. Also in July 07 rush, many who had already filed 485 with PD 2003 and early 2004 also got approved.
I know there were lots of approvals from Backlog Elimination center, but unless you work for a very good company, I doubt you will still be stuck with the employer from 2000 just for the sake of GC. When the dates were current, many moved to other companies, If you were here in US during late 2000 and 2001, that was not nice year for IT / Tech. Now where did all these old PD's pop from. Definitely sub has a big role to play. As I said in my earlier post, nothing can be done abt. this.

R u the primary applicant...so your wife got the interview...were u able to accompany her...so all the questions dealt with her....that's strange...I thought dependent applicant r not asked questions abt employment et al...

I have heard from the forums and also the attorney, that it is not unusual to call only the "derivative of the applicant"(spouse) for interview. But husband/wife may choose to accompany the spouse for the interview. Since I was there, I answered some of them too.

On a positive note, the best that we can do is, learn from our surroundings. We can learn a lot from Republicans to understand what not to do.
One of the main reason why Obama enjoys high rating - Republican party sucks. Who is making Republican party look bad - Republicans. The best response to Obama is not to pitch twisted Jindal against Obama, because that just makes Obama look good and it help Democrats. The better response to Obama is, let Obama respond against Obama. So simply don't respond to Obama, which will prevent Republicans making him look good. And like every politician, Obama will commit mistakes, which will cause the demise of Democrats. Its that simple. So what do we learn from this?
