The above part of your submission is not true. If you read the I-485 Adjudicator's Manual, you will find that the file is already opened and input into the system at this stage. Otherwise dwhuser would not have received I-797 Notice of Action.
In theory action on a case should be sequenced by priority date and then received date within the priority date batch. However, nobody knows for sure how USCIS works each case.
In the above scenario notice date acts as the receipt date and the received date mentioned on the I 797C is just a mail received date. I just called Customer service and confirmed that a receipt number is issued to an application on the notice date and mentioned on the case status. Hmm...that puts us in a backseat. Although we are officially current on priority date, technically it doesn't apply and we will have to let it pass and wait for... who knows another year :rolleyes:
Also, there is something I wanted to ask I was looking at our I 797C (I485 receipt notice) and found that the Priority date cell is blank. I have checked another I-797 (I-140 approval notice) and it is mentioned there though. Is this common ?

You are allowed to express your views without fear of persecution, but the IV forum is maintained by IV admins and they have the right to delete whatever they want.
Free speech means you can go start your own: oppose-interfile.org and no one will stop you. It does not mean that you can post whatever you want on any forum and people must leave it as-is.

I think the IO just say anything that comes into their mind because they know nobody's there to hold them accountable during the interview process. Thats why I think one should take an attorney along during the interview process if they think their case maybe little complicated. At least the attorney can step in when it comes to the IOs denying your application improperly. Does anyone think this is a good idea to be on safer side?
No matter what whether your case is complicated or not, it is always better to go with an attorney. My brother did that back in 2002 to represent him, but for the attorney his case would have been rejected even though his case was pretty straight forward.

What I am saying is just do not look into the issues that affects only you. Just be open minded. Show some sympathy to them. They were really affected. Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else’s small babies. She it seems had come here last year and taken care of someone else’s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old – who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child’s safety every day.

Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?
You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.
This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.
This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?
What are we going to do with that money man? This is nothing but a greediness.
Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.
Note: When you can hire a nanny that is legal/citizen for $350/week, then why did you hire someone illegal?

I have filed for H1B under the Masters quota but i will be graduating only in May and gave an official document from my University that i would be graduating. Somebody i know had also done a similar thing but he got a h1B rejection mail from USCIS yesterday. This has made me really upset. Is anyone there who has filed with a similar document and has received H1B? He had filed it witha consultant while mine is a highly reputed company. Will that make a difference?

You can do that and IV (core or its members) will not bite at you, because we know we are all part of the same movement, with the same frustrations, pain and stress associated with uncertainty. What is really needed is channelling the frustration toward action, mobilization and support at the grass roots.
The opposition is strong. But if we are to succeed, we need to work together. IV work is not easy. Takes time, commitment and money. Lots of people have been trying to do it for a long long time now. But circumstances and uncertainty/unpredictability associated with the legislature and governmental agency(ies) have always been the deterrent for IV's success.
Reversal of July 07 VB, multi-year EAD, Extended OPT etc. - IV has played significant roles. Under tough circumstances, IV has been able to obtain temporary measures that provide interim relief to you and posterity.
The day will come when retrogression will become history. But nobody knows what the calendar date of that day is. I surely hope that the day falls in 2008.
As a start, have you looked at the High-Five campaign started by a IV member? Please donate $5 for that campaign. That is the least you can do.

Reversal of July 07 VB, multi-year EAD, Extended OPT etc. - IV has played significant roles. Under tough circumstances, IV has been able to obtain temporary measures that provide interim relief to you and posterity.
The day will come when retrogression will become history. But nobody knows what the calendar date of that day is. I surely hope that the day falls in 2008.
As a start, have you looked at the High-Five campaign started by a IV member? Please donate $5 for that campaign. That is the least you can do.

It would be great if DC area news agencies are given a headsup about this act of gratitude toward Emilio... It would be nice if we can get actual reaction from Emilio.. he'l probably think he's been punk'd..
