Folks - another update on my case.
As i had been following up my case with the help from my Senator's office, they requested USCIS to give a written decision on my MTR.
Here is the written decision that USCIS gave
"On March 27, 2009, you filed a motion to reopen. You indicated the use of the applicant's ability to "port" under section 106(c) of the American Competitiveness in the 21st Century Act (AC21). The requirements were met and the motion to reopen was approved.
CONCLUSION: It is concluded that the grounds stated for denial have been overcome.
ORDER: It is ordered that the motion to reopen be approved. The Form I-485 is "pre-adjudicated" awaiting visa availability."
I hope this encourages people to go ahead with AC21

Congratulations...it's painful to see EB-3 folks wait for so many years and then hear EB-2 folks complaining about porting! Hopefully, all of us will come together and realize that the only way for us to get out of this mess is by supporting IV goals (no country limits, recapture, etc.).

ICICI Bank has started a 'Express Pay' service in which your monety gets transferred in 1-2 day but they charge 5 $ for that.
I think you might have selected that option while transferring. Thats the first option ...
My experience is even their 'Express Pay' service is a rip off unless you have experienced otherwise first hand !

I have done a lot of research on this topic and ended up in taking Tata-AIG. Few tips I can tell:
1. Try a high deductible: It brings down your rate significantly down. The way I saw it is, hopefully nothing will happen to my parents and for small things I have friends who can help them out. If there is something big I can afford a part of it and let insurance take care of rest.
2. have a few extra days than what your parents are coming for: say they are coming for 90 days get one for at least 120 days. Also make sure you get policies which are renewable.
3. Check on the insurance website if it covers hospitals in your area. I looked in one insurance where nearest hospital was 35 miles away from my home.
4. Look for ICU and surgical coverage closely as these two coverages are the most expensive and insurances tend to not cover it.

I had H1B valid up to 2010 (3 years extension because of I-140 being approved). Then I traveled abroad and entered US last December using AP. My new I-94 said "paroled in" and had an expiry date of Dec 2008 (till the date the AP was valid). Last week my company applied for transferring my H1B to one of it's subsidiaries as my position was transferred to the new subsidiary. They applied using premium processing and got an approval this week. My new H1 is valid for the next three years now (till 2011) :)
Also, although I entered US using AP I continued working using my old H1B. I did not use EAD. I talked to my attorney and according to them entering on AP does NOT automatically switch you to EAD. You can still keep on working on your original H1B. Since my H1B transfer was approved later I believe they are correct in this regard.

Yes, I'm on H-1B but I prudently avoided having any significant financial or personal ties in this country, because I knew this day would come.
So if something happens, no qualms about returning to India after 10 yrs of studying and working in the US. A person with skills will get a position anywhere in the world and succeed.

Exactly my thoughts. However, that does not mean that I am not proud of heritage and culture of my country-of-origin.
The vast majority of people are here on these forums for getting their GC and USC.

He contacted his senator to get the total number of pending EB apps for India.
Please see the response from the senator in the following link. It has pending applications by category.

Yes, we are not a third world country. Thats why we still see people like Harshad Mehta and Abdul karim Telgi. Both stock market and stamp paper, backbone of indian economy could be easily exploited by two individuals.
We are still manipulating the stock market. From 3000 to 21,000. Every sadhus, saint, soothsayers, magician, poojari's, astrologers predicting sensex to touch 35,000 by this year end. Even one guy predicted, 50,000 points in 2010.
I am just telling the fact. Look at TOI and other online newpapers economic section. Read the past year news.
Side note: stable oil(price) is the backbone of world economy. We know who manipulates this oil market and who gains out of it? Is it not a few corporations? But tell me honestly how many countries are affected by this inflated oil price.
One wallstreet analyst said. If you have Iran and Isreal in one statement, that is more than enough to shoot up the oil price. Why do we see calm and storm in the market every now and then?

Accordingly, unless the DOL changed the proposed rule, substitution of the beneficiary of the labor certification will be eliminated on the date of publication which includes the substitution of the beneficiary in the pending labor certification by amendment as well as the substitution of the beneficiary in the approved labor certification. For those who filed the substitution I-140 petition, the proposed rule provided that only "substitution approved" on the date of publication of the rule would survive. For the 45-day validity of the certified labor certification, under the proposed rule, the certified labor certification on the date of publication was supposed to have 45 days to file the I-140 petitions.
