However, make sure you also have a proof that when they applied for I-140 and you applied for GC, the company is still in good financial status; that is was only later that the company suffered losses.

I am on H-1B and wife on H-4. We did not get our stimulus payment last year since she does not have SSN.
For people who did not receive stimulus payment last year can claim it this year. So for people like me whose wives are on ITIN, can get $600 back this year or so I think. The way to do this can be:
First file Married filing separately, claim $600 credit and then amend it to file married filing jointly. IRS will not ask stimulus back. Let me know your thoughts on this idea. I wish I could get $1200 but hey even $600 is better than nothing.

Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.

What word we should use for july 2 filers who r still waiting for receipts as july 23 or later or even early august filers getting the receipts. People who got their receipts already boarded the bus, it is just a matter of time when they gill get the seat. People who haven't even got their receipts are still waiting for the next bus. First of all let me congratulate and thank IV for working tirelessly to bring about this huge benefit for most folks stuck in the green card mess. I have always believed in IV and its power to move mountains. However, in the midst of all this rejoicing, let's not forget a certain class of IV members who will not be able to take advantage of this recent benefit for all practical purposes. I am talking about the folks who are currently single and will not be able to file for their (future) spouse before Aug 17. It seems to me that the best thing that IV can do to bring relief to these folks is to lobby for and effect legislation to exclude dependents from the visa cap, i.e let dependents (or at least spouse) to file for I-485 even when priority dates are not current. I believe this single piece of legislation (if we can make that happen) will have a big effect on the entire community, because that will free up that many visa numbers that would otherwise have been used up, and let folks get their GCs faster (even if they are happy with their EADs and APs). Can IV focus on this front please ?

Buddies lets do something. We have always been low on priority compared to other pressing issues. Well Ok we waited, the economy is turning (well OK we will never see the actual turn at least we have seen retail spending up and some hiring, the stock market is going OK). When will be emerge out of the shadows and demand for a reform to the broken legal system? Cmon friends Get up, contribute, write to the senators, the president, lets DO something. Can somebody explain how unused visas are recaptured?
Will unused RoW EB-1 be given to the most retrogressed category (EB-2 India)? Or will they go to EB-2 RoW? What does the law state? Will per-country quotas apply when unused visas are used?
There is no clearcut guideline on how overflow is supposed to work. From people's experiences this is what USCIS has been doing:
unused RoW EB-1 goes to RoW EB-2
unused RoW eb-2 goes to RoW EB-3
until the last quarter of the year unused RoW EB-3 stayed unused.
In the last quarter, unused RoW EB-3 spill over into all other countries irrespective of whether the country has hit its cap or not. a complete free-for-all...

The only reason I want to still enter on H4 is that my H4 is stamped until 2010, hence why not use it and save money and hassle on AP entry. As you have said that working on EAD immediately invalidates the H4 status. This is OK for me, but at least I have avoided the AP procedure stuff. Plus the primary applicant is on H1 and hence we both can enter on H1 and H4 respectively rather than one entering on H1 and the other on AP. Let me know if this clears your doubt and if so, can you think this would work out. Also, if you can, please respond to my other questions

US Canada has different agreement and for that 40 credits are not required. Even if a Canadian Citizen has earned 1 credit it is transferred to Canada.
US has several type of agreement between different countries. With India, it is 40 Credit. With some of the countries, no benefit.
With Canadian Citizen's benefit is reduced by windfall limit. If Canadian citizen works 15 years in USA (60 Credit) and 25 years in Canada, total retirement benefits becomes too much. So it it reduced.
If there is such new agreement between US-India, the returning Indian Citizen may have reduced benefits if they work 10 or over 10 years in USA. For example if policy says max Rs.50,000 per month. Right now for a couple it could be equivelent to over Rs.100,000.
So although for returning Indians, this news is welcome news for Indians earning credit less that 40, it may not be so for Indians earning more than 40 credits.
(I used word - couple. USA pays retirement benefit to non working spouse also - equivalent to 50% of working spouse. As I remember, India does not pay retirement benefits to non working spouse).
(The social security benefits has several components - retirement, death, disability, unemployment, medicare, ... Medicare for sure is not available for Indian Citizen returning to India)

I know Immigration voice is not for profit organization and it is doing a great job.
My intention is not to belittle IV, my intention is just to express my opinion as a user, most of the problem will be solved if the links are not shown to non members if they are not allowed to see the content.
