Leadership-
Most of the senior members and Admins either have left IV or not able to spend enough time together to plan and organize action plans for the community. This is what I feel we are missing. We are acting alone although we are part of community.
We need to come together and keep ourselves focussed on common issues related with congress bills, retrogression, IV Agendas and road-map for coming months or years.
I mostly see pappu from core IV leadership. Where are other folks. If current leaders cannot lead us in the future, we need to find someone who could.
Again, my intention is not question anyone's hard work, but I am not seeing the same momentum and focus we had year back.

Most people think law suit is a bad thing, but that is not right. In a democratic country law suit is the right way to deal with things. We are legal immigrants, we have all the rights to file a law suit, but with full support of IV.
People have already filed a law suit on the same day the President signed the bill! (yesterday, the wire tapping bill...)
By filing a law suit, all we are trying to do is to fix the laws which are not working. Basically, we are doing the right thing. Not only us, but future Legal immigrants will be benefitted, they don't have to go thru what we had to...
Here are the things that needs to be fixed...
1. Country quota
2. Recapturing visas..
3. 3 year EAD/AP
4. End the endless wait ( Proposing a new law ;))
What is "End the endless wait" ?
EAD is a very good example, If 90 days have passed after filing EAD, you have the option to go to a local USCIS office and get a temp one. We should have a similar option for all the peper work. For example, each and every stage in green card process should have a a day count for processing. Like name check should be completed in 180 days.
Basically, when we receive any receipt notice, it should have a statement which reads "We have received your application and we will take action within 180 days. If we fail to act by MM-DD-YYYY, Please go to the nearest USCIS for approval.."
Sounds little ambitious ?? well, we are not asking for too much, just a day count. Lets say if the whole Green card process takes 3 years or 10 years based on the day count for each stage, people can decide whether they want to immigrate to USA with a clear idea that it will take x days to become a permanent resident ( like how it works in all other countries except USA)
Even a person jailed gets to know how long he is going to spend his time behind bars, but we do not know when we will be free from this immigration mess!

.... Our 5 PM meeting was with a Congressman himself and had a Core team member, myself and another member who was later offered an unpaid Internship by a lobbying firm. Just when we were wondering why the position would be unpaid we were told that the reason for being unpaid was because the green card process for the member accepting the position would be reset since it would not fall under same or similar category which made all of us crack up.
Was this intern an IV member or was this intern a member of the staff - and is the lobby firm that hired him working on fixing immigration issues?
Our closing meeting went on until 11 after which each one of us took our Action items and next steps to take back to our districts. Everyone we met over the past couple of days told us to keep up the work we have been doing for the past few years. Good work and great follow through always leads to good results.

No, it is not always a 2 month gap. Normally RD (on your receipt), the data entry date (you see online as "your case was received on..."), and ND should be in quick succession. It was only in July/Aug 07 when due to high volumes many cases (including mine) waited for data entry for months, as no center wanted to accept that additional responsbility. Those whose cases were entered in July/Aug 07, became ahead of those whose cases were entered in Sept and Oct 07, no matter when they filed or what their RD (as the receipt). People with PD in 2005 and 2006 who got GC last year were those lucky ones who cases were entered in the system in July, Aug (and may be some in Sept) 07. My case was entered in Oct 07, although I filed on July 2' 07. I did not get GC at that time, though my PD is May 04.

I agree its tactic to scare people and attract attention. I think USCIS is far better placed today in 2009 compared to what it was in 2007. If that was not the case they would have just moved the Priority dates to Mid 2006 like they did last year. But this year they are much better prepared in their estimates. In Oct the dates might go back but it will definately not go back to Jan 2000 or U. They might take them back to mid 2004 and start slow advance from there. Next year Sep 10 bulletion hopefully they can take them to early. I am sure in Oct EB3 I will also come out of U and will be some where in early 2002 status at begining and will advance from there on.

Even if 1000 of our ~41000 members contribute 100 dollars each, we can host two more events like this.
It makes sense to ask help from outside of the organization only when our internal resources are all exhausted. However, sadly, most of us do not want to even contribute for the good cause. :o
We can also ask some big companies like Microsoft who back legal immigration extensively to help us financially right?

If I am not mistaken, you can start working for a new employer as soon as they apply for a H1 transfer. You have 240 day period, in which it must be approved. You should be ok, assuming that you got the approval within 240 days of July 1st 2004.
Thanks deecha for your response , I am sorry that i was unable to frame the question properly.My question is traing period (July 1st 2004 to Aug 30th 2004 = 60 days) without pay on H1B is treated as Out Of Status??? Is this period(July 1st 2004 to Aug 30th 2004 = 60 days) counted towards 180 Days period (to be covered under 2445(K)) or not?

Guys,
I saw there are 50 replied to this post. Looks like people are more interested in others problems than their own.
Its pity that MOST CRITICAL issue we are facing at present - AC21 Denial issue, is having only 77 mails but everyone is jumping gossipping. Come out of this and show a unity to real problems.
Grow up and don't escape from real problems. Its our problem and we need to fight to resolve it.

Following up on my previous post. Here is the format for the ad and the affidavit. We went to the DC embassy to get the name changed and they have next day (business days only) passport-by-mail service. I don't think they have same day service.
Actual correct name: <corr_first_name> <corr_last_name>
Current Name on passport: <first_name_pp>
Name in US docs (Visa, SSN, Drivers Lic.):
<first_name_us> FNU _OR_ <first_name_us> <first_name_us>
Format of the ad we placed in Indian newspaper (TOI) and local US newspaper:
I, <first_name_pp> AKA <first_name_us> FNU AKA <first_name_us> <first_name_us> d/o <dads_name> R/o <indian_address/us_address> have changed my name to <corr_first_name> <corr_last_name>.
Format of Affidavit from India (on Rs. 10 Non Judicial Stamp Paper):
AFFIDAVIT
I, <first_name_pp>, D/o <dads_name>, R/o <indian_address>, do hereby take oath and solemnly declare as under:-

Placing the ad, getting the affidavit and posting it to US all took a total of 1 week. We went to the DC embassy early on a Friday and we got the passport with the name changed via mail by Monday.
Another friend of mine got the same thing done via the mail-in service. It took him 2 weeks to get the passport back.

-- Grass root & state level efforts work only when there are a lot of grass root workers. For example independence struggle in india worked due to grass root efforts. But please try to understand that things are different here --- by definition, we are immigrants, our numbers are limited in this country.
Simply put, groups working in isolated corners of the country are having no effect on the politicians, because each area has only a few people and the politicians are not seeing the combined effect.
"Grass root efforts" may sound very trendy, but are actually leading us no where............yes we need it......but at the same time IV has to have a strong leadership who can show their strenght by doing phone / lettere campaigns.

Name change depends on what exactly you are changing. If it is just the order of first name / last name, then you can get an endorsement in the passport.
Following is fyi based on my experience. I got my spouse's name completely changed in the US (Changed first name, last name, and removed middle name).
Before the change her passport the visa , immigration documents, SSN, Cred card, bank acct, Drivers license, etc were with maiden name and last name.
For name change in the US, I had to go to the local county court and get a name change order. This took a day in my county - may take longer depending on where you live. This court order is enough for updating all docs in the US such as SSN, Credit card, license, acct, etc.
For Indian passport, you need an affidavit and 2 newspaper clippings one in US and one in India. I placed an ad in the classifieds section of the local newspaper (costs $25 - no documents required). For Indian newspaper, I had to send these docs to the classifieds dept of the newspaper:
Local US court order copy with attestation from Indian consulate. (Gazette order is not required.)
After this I got new passport in new name.

You have to send attested copies of court order copy, Drivers license with new name, and new passport along with copies of past immigraiton documents The records will be updated during the next visa extension. Also submit all future applications in new name with court order copy. USCIS is very well aware of name change situations and it is not an issue.

My visa stamp has name some thing like that
XYZ ABC
FNU
xyz is first name ABC is last name
FNU is family name unkown
The passport has Given name as XYZ ABC ....and surname is blank
The EAD ,485 ,Social Security Card has
LNU ,ABC XYZ
The michigan DMV has refused to issue the Driver Licence ,They are telling the names do not match ...... Some how I have shown the AP document which has photo as identity and having name LNU, XYZ ABC ......accepted the documents . I know this is start of whole lot of trouble ...
Now I want to know how to correct these changes at USCIS ,consulate .......
God knows how many places ...........Totally confused ......

As I posted on another thread, I do not believe that all those old approvals are due to sub labor.
A large part is related to FBI name check; remember, they just cleared a lot of name check cases...Not necessarily a bad thing, but we always feared as to how big is that number and it is still early to see the full impact of "clearing of that backlog>"
