As for the purpose of achievement of efficiency of immigration benefits processing and adjudications, the system assists in the automated processing of f immigrant and nonimmigrant benefit petitions and applications. Both investigative and administrative records are maintained in this system to permit USCIS to function efficiently. Reports are also generated from the data within the system of records. This system of records notice enables DHS/USCIS to provide automated support to process applications and/or petitions for benefits; determine the status of pending applications and/or petitions for benefits; account for and control the receipt and disposition of any fees and refunds collected; conduct searches pursuant to FOIA and Privacy Act requests; and locate related physical and automated files to support DHS/USCIS responses to inquiries about these records.
Categories Individuals Covered: Persons who have filed (for themselves or on the behalf of others) applications or petitions for immigration benefits (other than asylum and refugee) under the Immigration and Nationality Act, as amended, and/or who have submitted fee payments or received refunds from such applications or petitions; current, former and potential (e.g., fianc[eacute]) family members of applicants/petitioners; persons who complete immigration forms for applicants and petitioners (e.g., attorneys, form preparers); name of applicant's employer; and individuals who seek access to records retained in the Benefits Information System under the Freedom of Information/Privacy Acts (FOIA/PA).

Individual's name;
Social Security Number (if applicable);
A-Number (if applicable);
Addresses;
Telephone numbers;
Birth and death information;
Citizenship or nationality;
Immigration status;
Marital and family status;
Personal characteristics (e.g., height and weight);
Records regarding tax payment and financial matters;
Records regarding employment;
Medical records;
Military and Selective Service records;
Records regarding organization membership or affiliation;
Biometric and other information collected to conduct background checks;
DHS issued card serial numbers;
Records regarding criminal history and other background check information; and
Case processing information such as date applications were filed or received by USCIS; application/petition status, location of record, FOIA/PA or other control number when applicable, and fee receipt data.
Record and Information Safeguards: Records in this system are safeguarded in accordance with applicable rules and policies, including all applicable DHS automated system security access policies. Strict controls have been imposed to minimize the risk of compromising the information that is being stored. Access to the computer system containing the records in this system is limited to those individuals who have a need to know the information
for the performance of their official duties and who have appropriate clearances or permissions. The system maintains a real-time auditing function of individuals who access the system. Additional safeguards may vary by component and program.
It ain't interesting? Don't try to be outsmart over the federal institutions! For additional details, readers may review the USCIS published notice.
can't they join two tables or data to find out that information ? Why they want to hide from us ?

Chandu - Can I Ask you something here.
Just today I was reading on the ac21 thread, how you lamented that we as a community dont stand up for injustice and how some folks are worried that writing AC21 letter may mess up their situation somehow ......
And right now , you are suggesting that the best thing is to get out of any kind of mess. So the person knew he was doing something illegal and his 8 month old kid was beaten up and you feel he paid the price and now No Problem and he should move on ???????????
Somehow, this 2 + 2 isnt equating 4 for me. What am I missing here ?
Sorry Chandu but I'm disappointed with you right now.
You misunderstood my point here. Everyone are doing things at their own risk and must be ready to face any consequences.
Our friend did know she was on tourist visa and illegal to work.
Let me explain what is happening on sulekha
You have some people advertising that they provide nannies for elderly care, child care, they provide food on daily basis and also provide cooks for occasions, services ranging from janitor work, to helping with groceries and all sorts of stuff.
This industry is big - very very big. Some agencies did tell us they have nannies on j1 visa.
We on this forum who are very vocal are the most innocent folks in the world when it comes to this kind of stuff and we have a straight tangential approach of punish someone for beating the kid.
Well - lets use our brains instead. Believe me - our community does not have any sympathy, because we are not united.
People can come on this forum and give advises - but the person who implements it must know what he can expect and that's why he posted here. Our friend is on h1b and maybe having his 485 pending and he must have careful thoughts before he leaps into something.
What is the guarantee that a certified nanny wont ill treat the child. I have heard that nannies need not beat the child but do give mild sedation to babies in their milk so that the nanny can be in peace. If a nanny is doing that do you think she will be caught on tape?
There are tons of things nannies do and you may never be aware of it or may not be caught on video tape.

You are right, he kept on bluffing saying that he will apply EB2, blah blah.....it was my stupidity that I believed him and did not accept the reality. I am at the receiving end, what ever I try some where else I am hitting a brick wall. The only option for me is to get a pre approved labor and follow the whole 9 yards again. A very good analogy for some of these desi companies is they are like pimps. They market you or you market yourself and they will keep ripping you........man very frustrating......any body has similar experience. I can be contacted to share about my H1 slavery experience.
I noticed that some of the good words that I used to describe my employer are deleted, so I am not using again.

also got the following response for a service request i put in. did not know what to make out of it - is it just a regular response or is this true
The status of this service request is:
A review of this case indicates that it appears to be outside of the normal processing times, however processing times that are posted on our internet website are approximate and not exact. This case is considered to be within our current processing time. USCIS is aware that according to the Department of State?s Visa Bulletin, there appear to be visas available however there has been an extremely large volume of case requiring visas. Therefore your category may have already reached the maximum amount of visas available, so please continue to watch the Visa Bulletin in the future to check for visa availability for your category.
I would be damned if they issued a visa bulletin after being aware of the fact that the visas are over. this is just to cause anxiety and stress to people waiting in the line and just playing with their emotions. this is something really horrible and we should take this very very seriously if those fuckin assholes are not doing their job appropriately.

my reply was only meant to highlight what you have been doing on this thread. i do not care who is in which EB category. and i know exactly how people with masters degrees suffer in EB3. however, for you to argue that all category preference should just disappear, is quite ridiculous and i have explained the reasons to you. that does not mean people in EB3 are not suffering or that all those in EB3 are either holding advanced degrees or 3 year bachelor degrees. that stereotyping is in your head alone. certainly not in mine. you never answered any of my questions though. what would be the effect of YOUR solutions? would people like me EVER get a GC?
please do not unload your frustrations on all of us and derail what should be important.
iv has one goal- to end retrogression. period. iv's founder belonged to EB3. so do several core members. you have some funny perception that iv is about EB2. so be it. ironical though, because iv is commonly accused of being an entirely EB3 india organization.
so let me hear how the following things iv has constantly been fighting for, are somehow not helpful for EB3??
recapture GC
exempt families
remove country quotas
as for STEM exemption, if EB2 clears up, where do you think the GC numbers will go? what should we ask for? exemption for all??? not to mention that would get YOU a GC as quickly as possible and would LEAVE ME OUT. i still call and lobby for STEM exemption. i don't whine and moan on the forum about how it excludes health care professionals. if i have an issue, i work to resolve it- note the iv-physicians chapter in my signature that works to resolve specific issues. i created it and we have had success in reaching lawmakers with our problems.
anyway, iv is clearly not about a few leaders. the tone on the forums and the discussions are dictated by its members. iv has more EB3 members than any other category. so now ask yourself, WHY does the forum seem to discuss more EB2 issues (at least to you) ??? whose fault would that be if it were true? who needs to take responsibility to highlight their issues?
you have the option to change your job sir. if you are so frustrated, find a job that is up to your skill levels. you will not hear me on this forum complaining that EB1 should not get preference- hey i contribute as much or more. so why?
get with it. we fight the battles we think we can win. ANY GC numbers/exemptions will move everyone ahead in the line. what part of that do you not understand?
and now again. stop this divisive crap. we have more important issues to deal with.
Excellent post. My thoughts exactly.

Also, if what you are saying is correct- then DOS will immediately post a revised September 2008 bulletin to show India/China 'U'. So, that fresh I-485 filers won't be able to file. We have not seen such action on the part of DOS.
For example- Last year when they made July VB Unavailable on July 2, 2007; after adjudicating 25000 applicationsover the Jun. 30- Jul. 01 weekend , they immediately made an announcement on July 02, so no fresh I-485 applicants can file. The rest is history...
You said that you are from the Midwest, but your profile says that you send your application to Texas. How is that possible, All midwest I-485 applications must have gone to Nebraska Service Center.
"I am in Midwest and not all the USCIS/ASC offices treat as bad, as these guys may not have that many applicants coming to the office, like int Northeast or California."

Guys chill out...go out for a movie or something.
This is not in anyone's control.
If EB2 visa numbers get exhausted, new visa numbers will be allocated again.
I'm pretty sure within EB3 dates are also going to move forward.

Here is another case:
My minor daughter's Last name was missing in her passport but all her immigration documents (I-94/H4/AOS- r. n/ EAD/SSN, yes she got ead for ssn but never used it till date) somehow had her first name + LAST NAME. We initially ignored her missing last name in the passport but during her AOS finger priniting, asc guy noticed missing last name, made a noting in their system as "LNU" and advised us to get it fixed. We went to Indian consulate, Chicago and got the last name entered in passport, after due paper formalities.
My question to you guys is: Do we need to do anything else with respect to her AOS as all her uscis documents including I-94/H4/EAD/ssn, are already wth first name + last name ?
Any suggestions on this sitution will be appreciated !

According to a specialist on immigration forums "Mr UnitedNations" the unused visas are directly being used for EB3 ROW , I am not how he knows that but maybe thats what is happening.
Maybe EB3 ROW being a diverse group is being given more precendence than highly subscribed countries.
This information was there on a visa bulletin. This is not a guess but a confirmed fact.

What Details? I have mentioned in one of my posts here that my PERM has not yet been filed....No details regarding my green card processing.....Please read my posts to get more details on this.
Admin need to add three more options to 'Processing Stage' info in the header, 'Not Yet Filed', 'Not Interested in GC', and 'GC Received'. N/A should be removed, as there is always some Processing Stage.

Everybody who reads this thread should either donate themselves or if they have already done so, then make sure you talk to a friend and convince him/her to donate. You are not doing any public service by donating to IV (nothing wrong with those kind of donations). Whatever you donate will actually come back to you as a benefit you really want and in a much bigger multiple.

Hi ps3539 (Mr Genius)-->
What should be done to people who already got their GC or Citizenship using substitute labor? Should they be kicked out of the USA?
the point ps3539 is forgetting that it was LEGAL. There was nothing illegal about it in those days. Get over it.

As I see, those who substituted labor would not want their priority dates moved back as per the date of substitution (filing I-140). This is an open forum.

pappu, pls let me know, if u received the fund. Also, one small suggestion, we can just maintain a small excel sheet, to just see who (just the user id and not the actual name) contributed and how much money they contributed just in this campaign. Cos, I hate to say this, I just dont want to be around those who want to have a free ride from all the hard work that IV group is putting in. Please everyone please donate. If you are reading this post, if you have not contributed earlier, please contribute. Dont you want IV to become strong financially when fighting this tough case. They need all the help they can get. So, please anyone who is going through this forum and not contributed earlier, please do contribute. This will help us go a long way. Thank you and god bless IV.
Thanks. It is tough to keep a sheet. but if people just post a note on the forum that they paid it will help keep a tab on #of contributions. It can be verified and we will know who has contributed.
