I have checked with my company's lawyer and he said I can maintain H1 status with my current employer and use EAD for part time job. I read murthy chat transcripts and same topic was discussed with two different answers. ................
I work for a very big company ........................I do not want to be limited by work authorization limitations...

Using H1B makes one safe. but how many years we want to do the safe job. If I-485 gets denied do u have enough patiences to file another green card. One thing is believe is "We are here to make money, most of us are in our thirties and we have short time remaining to reach our goals. I think we all have one year EAD. wait for 6 months then go on job hopping, learn whatever you can, get into whatever you want. Start a business, do something.... Anything you do will help you in future. Sitting with H1B in pocket may take 4 years cream of your life.
If you have the talent you can get great salaries anywhere in the world. Because of your talents and hard work you guys are here. World is not small.
I-485 is mostly about the eligibility of the individual (like medical, illegal presence, fraud etc.) and so getting rejected at I-485 stage is not that common (especially after the approval of the underlying immigration petition). And if it does get rejected, more often than not, the individual may never be eligible for permanent residence due to the same reason. So usefulness of H1-B as back-up is of very limited narure.

Now I see many people are ready to dump it if they see an opportunity to use EAD. That is good to know.

Imagine if Uncle Sam held an auction to allow you to submit I485 EAD AP, what would you have bid for the right to submit?
Maybe $640, $6,400, or even $64,000?
If Uncle Sam charged a fee to submit now rather than waiting for another year or two or three... What would you have paid to submit I485 and get EAD AP AC21?
Alternatively, how much are you going to benefit from EAD AP or AC21?
AC21 -- maybe ability to move jobs and get a few thousand $ pay rise?
AC21 -- maybe not going to the back of the queue -- really worth thousands!
EAD for you and spouse -- maybe a week of salary for someone that could not previously work?

Hello IVians,
As we all await our GCs, I thot we can explore some investment vehicles.
Does anyone here have experience with commodity trading?
Can we trade in commodities on H1 or L1 status?
Is it too risky like forex trading?
Who are the online brokers offer commodity trading?
Is there a minimum account balance / trade required every month or so?

Commodity trading is probably the most "fundamental driven" (as opposed to being driven by chartists) out of all trading activities I have seen. So theoretically, you are at the least disadvantage in commodities market against the big guys if you know your fundamentals right.
However, the very reason there is less technical trading in that market - lack of liquidity - again works against the average Joe. The most liquid of them - the Crude Oil future in Nymex - has a minimum lot size of 10,000 barrels - worth about $60k now. Any smaller sized derivatives (think of miNY futures etc) - come with significant liquidity or transaction cost penalties.
All in all, I personally think that a rational investor should prefer a market with the following criteria:
1. As much liquidity as possible. A liquid market will make stop loss the least painful. If you are a rational investor - stop loss is your lifeline.
Commodities market is not very liquid. The most liquid market in the world is FX - followed by equities.
2. As little special advantages for the big guys as possible.
The worst offender here is FX. Since these things are not traded in a listed exchanges - the big guys don't have to publish anything other than the bid and ask prices. Talk about a transparent price discovery. :confused: . Commodities market - specially the electricity market - used to have a lot of the opacity which benefited the big guys a few years ago. Some of the recent regulations have done away with much of this. I have personally worked on creating some of these so called "Chinese walls" mandated by new regulations.

He is not talking about Indians, rather he talks about H1b in general. Since India does not have equivalent social security system, US Govt and Indian Govt did not sign any contracts. Other countries like Canada / UK / AUS have mutual agreement between them and US for transferring the social security paid in US to be transferred to their home country if the alien returns to the home country.
Even Indian Govt (P.Chidambaram) I beleive is working with US Govt to get these SS paid by Indians who have returned back to India. Since the US system and Indian system does not allow with the current rules and regulations to transfer the amount, it is stalled. may be down the line even India would work with US to get these amounts back.
I heard something like this, but not sure: If you decide to move back to India, you can fill out a form and submit to INS/IRS which states that you will never come back to US for any reason. If you do it, they will pay your SS money back. I dont know anymore about this.

House Resolution 6020 would help some of the more than 45,000 noncitizens serving in the U.S. military as of March 2007, said Grijalva, a southern Arizona Democrat.
``Some families fear immediate deportation if their noncitizen soldier is killed on active duty,'' he said.
The bill would permit family members of such soldiers to become lawful permanent residents.
A second bill calls for basic health care for detained immigrants.
House Resolution 5950 would set medical care standards for immigrant detainees.
The secretary of the U.S. Department of Health Services would be required to establish procedures for the timely and effective delivery of health care to detainees and to report the deaths of detainees to the agency and Congress. It would require any necessary medications be provided upon detention.
Grijalva may not he done yet. The congressman said he is considering co-sponsoring two more immigration bills that have bipartisan support.
One eliminates the per country limits on foreign workers who can obtain employment-based visas to work in the United States.

I saw posts quite similar to my situation so didnt start a new thread but instead thought of using this thread to ask my question.
My situation is
I have my EAD and AP, and my 3 year extension is already approved but H1 stamp has expired.
My wife has used EAD and her H4 extension came before she stopped working on EAD. But she does have 3 year H4 extension too with an expired H4 stamp.
Now we plan on travelling to India next week and i am kind of confused as to whether we should go for H1-H4 stamping or not, or should we use AP to come back.
I have read in so many threads and forums that even if you enter on AP, ur H1 status is valid.
Now if my wife goes for H4 stamping, will the imigration officer consider her under H4 or AOS as she has used her EAD?
Since i have 1 month to come back to US, I am scared if for any reason Immi officer might take time to stamp visa on our passport and we might not make it back to US in time. And also what if they ask all questions regarding GC.
Has anyone gone through the same situation?
SInce these days, mostly all companies are hiring people who have EAD, sometimes i think what is the need to maintain H1 then.

I went for the visa stamping in chennai consulate on Dec 5th. After a few questions, the officer granted me the visa and said i will receive the passport in a few days. But so far haven't yet received my passport. Does anyone know what is happening? is anyone faced such situation before? I heard about this admin processing and delays in stamping but i thot the officer would usually give out some kind of form to you during the interview if your case goes thru such processing.
The web-site says we can send an e-mail to the consulate regarding any questions for NIV if it's pending more than 5 days. Has anybody done that and what would be the response?
Please respond. i am running short of time as i have to travel back to US soon.

2) The Feb.2003 approved H1B with LUD 0f April 2006
For both cases, it seems the status is the same as when it was approved in Sept. 2000 and Feb. 2003, nothing new. Maybe these are automatic updates by the computer system.

We all can certainly do one thing, we can write emails, letters to editors and media talking about our personal situations, highlighting EB visa backlog and how that is hurting legal-tax paying aliens like us. We can raise awareness in the media and we can bring new members.
When something is asked of us, we should do that. Pappu asked everyone to write to the editors thanking them for the story about immigrant entreprenuers. Just yesterday, we had some people come forward and write to all these editors.
Myself and some other members even posted names and emails of all the editors that we should thank in the "news article thread". If all of us can go there and write emails and flood them with thank-you notes, we will get noticed. Remember the print media business is based on how many readers they have, we have to make them feel that this issue is very important and is getting them more readers and membership.

Immigration is a privilege when we enter the country. But when we have been here for such a long time, paid our taxes and respected the administration and bureaucracy, it�s our right. As for the job loss, no job is certain for anyone. But at least a GC holder can look for alternate jobs. He is not tied to his labor cert/employer. When employees post for job, they might say �need a citizen or gc holder�. But never say we only need a H1-B holder. So when we have respected and followed the rules of this country immigration becomes a right as logic life suggested.

My story is of a bright engineering student from India, who came to USA to study a graduate degree from one of the top engineering schools in USA. I graduated with a 3.6 GPA with a Masters degree In Computer Engineering and Electrical Engineering from top 10 engineering school, University of Southern California in 2004.
I immediately joined a company, working in the Health care industry and providing software for many of the most large and research labs in the country, providing patient care to all parts of the country.
We applied for a Permanent Residence visa in the Employment Based Second (EB2) category. I have not missed a single paycheck since nearly 4 years, paid all my taxes in February 2nd week latest each year. I have studied in a premier school of USA and contributed to research and studies for nearly 3 and half years there.
There is a huge backlog of visas in the employment based categories. The backlog is in hundreds of thousands. There is a limitation of 120,000 visas each year, with a limitation of around 8400 visas for countries. This means countries like India and China which contribute the most to legal employment based immigration look at a wait of 6 to 10 years. In this time, we cannot take career decisions, are afraid to buy houses, are afraid to invest in 401k and retirement schemes, all life decisions come to a halt.
During the past years, a lot of visa numbers were left uncaptured because of processing delays. Also, family numbers count for single visa numbers. And there is a per country numerical limitation which is unfair to countries like India or China. There is no consideration for applicants with graduate and PhD degrees in Science, Engineering or Math.
Generally the illegal immigration gets all the focus, with us, legal immigrants, not even getting a mention. H1 visa category is chastised and in bad press, but we are all but a very few number of intending immigrants, who instead of taking jobs, are contributing to economy, legally residing and want to be a part of the great country. Many bills HR 5882, HR 5921 & HR 6039 are already in government waiting for action.
Please help the legally employment based immigration group.

The word is out to Santa Clara University Int'nl Students. One concern.... Im getting responses from guys from other nationalities... do we need to worry ?

I wrote letters to Charles Oppenheim who release the VISA Bulletin about not using the VISA Spill Over.. I think this is the best option today to make a lot of noise by writing letters and there is a good chance that he will take notice an d release the spill over.... I urge all to write 2 - 4 letters to him ASAP so that we can see some action before next bulletin...
