    On the page you quote, below is what I see -

    The Civil Rights Division of the Department of Justice enforces federal laws that prohibit discrimination in:

    Education
    Employment
    Housing
    Lending
    Public Accommodations
    Law Enforcement / Police Misconduct
    Voting

    The "per-country limit" is definitely unfair within the realm of employment-based immigration due to the outdated and irrelevant law which needs reform. However skewing this to make it a civil rights issue is pushing it a bit too much.

    So coming back to Immigration (which is what, I believe, we are discussing), below is what I came across on congress.gov.

    The Supreme Court has ruled that the Congressional power to regulate naturalization, from Article 1, Section 8, includes the power to regulate immigration (see, for example, Hampton v. Mow Sun Wong, 426 U.S. 88 [1976]

    In other words, the Constitution does not specifically mention immigration but based on the above, delegates power to the Congress to pass laws to regulate immigration. This Article of the Constitution also clarifies the part about rules for immigrants and quotas being set at the Federal level and not State level.

    The above is a fact, not my opinion. Therefore, No - I do not agree that your reasoning has any direct parallel to our case since the correct approach and reasoning involves challenging a Supreme Court Ruling on Article 1 of the Constitution, which you would agree is next to impossible.

    There are far too many points here to address at one go. Let me touch upon this for starters:

    The Article 1, Section 8 has this clause, regarding the power of congress:

    Clause 4: To establish an uniform Rule of Naturalization

    Are we disputing the fact that congress has the power to establish a uniform rule of naturalization?
    No. We are not. We are just saying, that the current Rule of Naturalization is in violation of the discrimination clause in the constitution, and ought to be disregarded. We are not asking to strip congress of this power, so this argument you make is not relevant. Agreed?

    I guess I may fall victim of FBI background check. Even though, my priority date is not current yet but, it should be next couple of months based on recent EB-2 movement. We had our AOS interview last Nov and IO told us that she is going to initiate another Background check as original BC is more than two years old. In the end of April, I made an Infopass appointment out of curiosity because Background check use to be a major source of delay for many people. Service Rep on window told me that my Background check has not come back yet.. It was almost 5 months since it was ordered.. She did not elaborate on why was it pending.. She asked me couple of weird question which did not make any sense to me. I have schedule another appointment in next couple of days to find out where do I stand. I would like to keep my expectations in check as pending BC can delay it even when priority dates are current.
    Can anyone on forum please provide some info on what can be done if Background check is pending over 180 days.. I can make a request to my Congressmen and ask for their help... Any suggestions will be greatly appreciated..

    Unless US govt. declares bankruptcy, AP real estate would not burst so it would be safe to invest in AP.....

    If an aparment costs 70 lakhs and that is renting for 15 thousand, how does it make sense to invest in it? The return on 70 lakhs at 12%(or 10%) is 7 lakhs/year. That is approx. 60 thousand per month. If you buy an apartment and rent it, it gives you 15 thousand. Don't you see the problem? The return on investment is low, very low. The fact that it is renting only for 15 thousand tells us that it is not affordable for most of the average guys in the city. The theory that there are more demand to snap up 70 lakh, 1 crore apartments is simply not true.

    Let's just compare it with membership-based organizations like IEEE, for instance.

    You enroll/become a member, you get access to member-only areas of the web site, and plenty of other benefits to make membership worthwhile.

    Earlier today I received a mailer from "The Club" (Commonwealth Club of California, iirc). For the benefits offered, and for the general spirit and intent of the club, I thought the $85/110 membership dues were quite reasonable.

    My question comes back to IV - why can't 10,000 or all 25,000 of IV's members decide what we're doing is worth it, the access to information is worth it, the free legal guidance and advice is worth it, and other benefits (that may be thought up... for instance travel discounts, etc.) are worth it - to "contribute" to IV (call it whatever you will - contribution/membership dues)?

    Next, of course, is the concept of "premium" membership for web sites like WSJ.com, or technical ones like Experts-Exchange for instance. You join, you get premium content. IV has much more to offer than just premium content here.

    (As a sidenote, one example is members getting newsletters - online or paper - with expert legal opinions and answers on our most common questions. Authoritative, as much as they can be, with documentation where required... rather than spending 2 hours searching the forums and still coming up blank or inconclusive... )

    There are other logistics issues that can be resolved, and *we* = all members, will empower IV to do a lot more by doing that, imho. I can think of 20 things we can do in addition to this lobbying effort - and we won't have to start a funding drive each time we decide to do something.

    Thanks for participating in this debate and making your opinions known. Most importantly, this is about brainstorming and coming up with more ideas - regardless of whether we take this membership-only approach or not.

    Ultimately, whatever IV is able to accomplish will benefit the entire legal immigrant community, regardless of contributions/memberships. However, the need of the hour is to realize the opportunities we are missing because of lack of resources and hands in most cases.

    I guess you are talking about premium membership like wsj etc. I am not sure a free exchange of ideas can occur if we put our membership for sale by restricting access to some parts of the website. IV will lose some of its sheen and I am not sure the tradeoff in membership $ is worth it- dunno just doesn't feel right in the gut

    Numbers USA people are angry right wing citizens.

    Calls from legal aliens who can't vote won't move lawmakers one bit. Money and votes are the only 2 things that matter to politicians.

    Pressure groups and lobbyists have far more reach and influence. IV as a group can use lobbyists and other influence to get a lot more done. Individual phone calls are a waste.

    We absolutely must make all forums accseible to registered members only and,

    bringing bk the discussion to more serious point. We can all agree that on the surface immigration system here is seems unfair towards Indian, Chinese and Mexicans. Whats the reason behind it? why only three countries which suffers from long waits. Its demand and supply. If there were no country caps, all the visa's will be absorbed by these three countries. Even though it has cost me time and money, i think its the right policy. for a moment imagine there was no country limit, can you imagine for few years to come immigration will be from only these three countries. i think its only fair to limit how many people can come from one specific country.
    and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. We treat them like dirt back home, so discrimination against immigrants is part of immigration process. hopefully our ABCD offspring's will face less of it :)

    I didnt know you have such doubts about the efforts of IV and its goals.

    Anyways, have you every picked up the phone and called us to ask us what we are doing at that moment? What we did last week, what's our plan next week? You know, there is a phone number listed at several places on the website. That phone never rings. Oh yes, never. So who come you never seek answers where you can get them?

    We have told several times, that we dont have time to keep everyone in loop about everything we do in DC, including every time we meet some staffer or someone. Sorry, that's just how it is.

    Last week, Aman was in DC on Thursday and Friday (Jan 25 and 26) and had meetings with 3 senate staffers who work on Immigration. Then he went to India, then he came back straight to DC monday morning and since yesterday, he has met with 2 more staffers, our lobbyists.
    We are also trying to find out about the schedule A rumor and if its true, to have the recaptured visas go to all categories not just schedule A.

    So there, you have your update? If you want to know more, then call us on the phone.

    And this update is the kind of update we dont usually post on forums. This is mundane advocacy stuff. Find me one organization that gives hour by hour update of what they are doing.

    If you dont trust us, what are you doing here. Why dont you join the "bash IV" party at immigration portal and enjoy criticizing the arrogant IV core and its stupid blind followers. I am sure you will find many enlightened fellows like over at portal who are smart enough not to follow or believe in IV.
