This is same rule in MN too. My wife extend her H4 with dirver license. You need to get her H1b approval first and then renew her license with new H1b Expiration Date. Hope this will help.

You can change the job peacefully using AC21 since your 485 is pending for more than 6months. Your labor position/location etc doesnt mater. Your current employer cannot do anything but you need to get a copy of labor and I140 from him to use AC21. Also your next job should be same or similar to the one in the labor certification. I am an undergrad student at purdue. I went to a community college for a year and transferred back to purdue. I did not fill in any paper work or anything and I was put out of status as per my international advisor. I handed them a all the documents that were needed for reinstatement. they told me it take 3-4 months for reinstatement and i should stay the US in the meantime.
Now being said that I filled it on 10/9/11 and i am gonna be dropped from purdue on 10/17/11. I am planning on attending a community college for the coming semester and they will not accept me with a terminated record.
So my questions are -
1) Will immigration department check back with uni if i am still enrolled (note: i got paper signed from my advisor with my graduation dates on it)
2) Should i leave US and apply for a new visa and a new i 20 with that community college?
If yes, then what are my chances of getting a visa?
3) What are my options??
Please advice. I am at crucial crossroads of my life.

Am currently on h4.my husband filed new h1b for me in april 2009 and it got approved in August 2009.
But when he filed my h1b i was in india.
i came to us on June 2009 on H4 visa.
can i go ahead and apply for change of status from h4 to h1b and start working.or else should i have to get my h1b stamped before i start my work.please advice.

I have a PERM filed on Nov 2006. and it is approved. Like most ppl here I also applied for I-140 & I-485 during July and got the receipts. I am looking to change companies using AC21 by next Jan but would like to keep my H1B active.
I have the following qns:
a. If I find a new employer(B) who is willing to transfer my H1B, will I get extension 3 yr extension beyond 6 yrs based on my current employer(A)'s PERM and approved I-140.

i think at re-entry for the 485 pending /AP applicants, there is a POSSIBILITY that the officers could question you bout ur existing employment. For such cases people r adviced to carry the current employers letter along with copy of 485 receipt for safety sake.
with that in mind, if all possible, using ur EAD(after that 180 day rule) , get a job may be collect a paystub or 2 , get a letter and then use the AP.
in many other forums, pple have shared info such as "officer asked me if im still employed with the same employer who filed for GC." etc etc . its better to carry something atleast to prove that when asked.

Is the postal address same for EAD & AP renewal for e-Filers.
The forms that printed out for EAD & AP renewal for e-Filers shows same address to send the supporting documents.
And only EAD needs the 2 photos right not the AP for e-Filers.

Does anyone know if we need any special visa for working in Canada if you have a US GC?
One of my relative did work in Vancouver, Canada with his GC. He got his work permit at Canadian port of entry. Anyway this was long back, so please do your research, rules might have changed since then.

While you could have two H1B with two different employers, it is logically impossible for both to be full-time positions. So logically, you could have one full-time position and one part-time position or both as part-time positions. In either case you I-129 will have to be amended to show that you are in part-time position with the employer.

Currently working with Company A, where I have I-140 approved. The employer is willing to file I-485. Also have a better offer with Company B, and have H1B approved. Is it possible for me to take leave from company A (using my PTO) and joint company B, keeping both jobs on H1B status?
As my H1B is valid with 2 companies, and both are for full time positions. Is it okay for me to be actively employed with both companies at the same time for 2 or 3 months? Do I violate any H1B regulation, that may cause denial of I-485 at later stage?

I came to US on B2 10-year multiple visa, my I-94 is going to expire in a few weeks (first time extension approved ). My husband�s citizenship application has been pending for the past 10 months, it is in internal security check , so don't know how long it will take to clear.
What are the consequences if I over stay on my B1 visa for about 150 days, during which I apply for my I-130 and then go back to my home country and go for the consulor processing. Is this can be done? I got different opinions so confused. Would it impact my consular interview?
The hope is my husband�s citizenship would be approved before that and I might never have to leave the US.

It is better to maintain ur F1-status (meaning all that needed to be on F1) atleast till you get receipt number.
(So that there is no need to worry incase ur application gets rejected and you dont get receipr number).
If you are on F1 while applying i-485, There is no clearly defined rules on when your F1 status goes out after aplying I-485.
If you are currently on valid F1 status then you can keep that status if you want to, provided if you obey all F1 rules
In general, If you use I-485 EAD and AP you are almost out of F1-status
