Dear Lawyers,
I am a registered professional civil engineer in the state of PA having an educational background of a BS from India and MS from the US in civil engineering. I got my H1B extension approved last year for its second term of three years. I have been working in the same company since my graduation and also hold an approved I-140. I am planning to visit India in March to get my visa stamping done and am concerned about the reports of valid H1B holders being returned from Newark. Do you think I should avoid Newark as the PoE?
Thanks and regards,
Nishant

I am applying for a green card and my lawyer sent me a case number starting with an A and in the format : A-#####-##### for my PERM.
I tried http://pds.pbls.doleta.gov/ but it does not accept case numbers starting with "A".
Can you please tell me where I can go to look at the status of this application?

Hi ,
howmany days will it take by USCIS to give decision once after we submit all relevant documents for I140 RFE.
Center-TEXAS
Thanks
usually 1 to 2 weeks (atleast in my case it was 1 week),
hey, but again never forget that you are dealing with USCIS, they are consistent in being inconsistent.
good luck and hope you get your I-140 approved soon. :)

I've seen people getting the GC Approvals even though their PD is not current. But close to current published dates.
Good Luck to you and Keep your fingers crossed. Technically you are not in, but still you may be in. You never know with USCIS.

He/She can join old company as long as H1b from the old company is not revoked. There is no need for any H1b transfer as long as old company's H1b is valid. Just go and join them back if they are willing to take him. Lot of people of H1b do this. Hope this helps.
This really helps. Thanks

Great story, another example how the illegal immigration debate is now a big part of our culture.
In 1993, when I was 14, I became a regular on Sesame Street. The show usually liked to have a teenager on, so that was me. My character had my same name, Carlo, and eventually I got a job at Mr. Hoopers store. I had to make a birdseed milkshake for Big Bird, that was my tryout. I ended up appearing on Sesame Street for five years. But the whole time, I had a secret: I was an undocumented immigrant. The papers Id used to get hired were fake.My family had come from Ecuador when I was seven and my older brother Angelo was nine. We came on a tourist visa, and the moment my parents had gotten it, we knew we were not coming back. They sold all our furniture before we left.
My mother had a sister living legally in the United States, and my parents planned to have her sponsor us for residency. Soon after landing in New York, my parents saw a lawyer. But we were told the process would take four or five years.
Coming to the States was traumatic. In Ecuador, we had lived in a house. Here, we were in a small apartment. We didnt know any English. But you know, at that age, things change quickly. In six months we were speaking English and running around like normal kids. Most of the time, we blended in. But we knew werent supposed to be here, and we lived with a lot of fear.
I started acting when I was 11, almost as a fluke. One day, we went to visit our cousins, and they were on their way to try-outs for a community theater production of Oliver! It was through a program put on by the city, to get disadvantaged kids off the street. When we got there, the producers were like, You should try out, too. So my brother and I did. Then we all went to lunch. When we got home, we had a phone message that wed both been cast. I was Oliver.

Please clarify:
When was your labor cert. application filed?
Is it still pending?
On what date did you first enter the US in H-1 status or first obtain a change of status to H-1?
Since you first entered the US in H-1 status or since you first changed status to H-1 have you spent any time out of the US?
If so, how many days?
When in 2008 did your new employer file its H-1 petition for you?

I have been noticing a lot of people moving changing jobs using EAD. Especially a lot of June and July 2007 filers.
The time to renew EAD is approaching and I am sure there is going to be a surge in EAD renewals.
There was also a recent communication from USCIS that one must not apply for renewal prior to 120 days of their EAD expiry date.
In past has anyone been in a situation where they are not able to renew EAD in time and how you handled it?
Do you plan to apply for EAD exactly in the 120 day range to make best use of time? What if EAD renewal gets severly backlogged?
I think this is something we must all concentrate on and try to get some answers from USCIS on this as it will help planning.

Hi,
I need some clarification/suggestion regarding my status.
I came to US on F1 and am currently working on H1-B (never got H1 stamping) and I got married here in US. I applied for 485 as dependant with my spouse and I got my EAD/AP. I am still continuing on my H1-B without using EAD. We are planning to go to India in Dec and I prefer to use my AP while entering US and would like to continue working on my H1 (continue with same employer) after coming back. Is it possible and valid to do like that? If its ok, do I need to submit any form or anything to USCIS informing that. I prefer not to use EAD. Hope I am clear explaining my situation. Please suggest.
