I travelled via Frankfurt with a valid I-797 and without a current H1B visa stamp (was going to India for my 1st stamping) last year. I had confirmed with the German Counsulate in US that as long I have valid I-797 I don't need a transit visa.

Hello,
My labor certification was filed in December '07 and is in the process of audit (Fragomen law firm issue). Meanwhile, there is news that my company is being sold off. Will I be able to continue my GC process if the company gets sold off but I am able to retain the same job and title.
Is anyone else facing a similar situation? What are my options here?

My I-485 is pending and priority date is OCT 2006. We have EAD which expires in DEC 2010. I also have H1B visa which expires on JUN 2010 (After 3 years of extension after I-140 approval.) My question is:
1. Is it worth having H1B visa extended just in-case? Will extending H1B visa cause any problems with pending I-485?
I appriciate yr help.

Hi guys,
I know this is Off Topic (OT), but I was wondering if ALL Tax payers including immigrants on H1B will be getting the proposed tax rebates. This had happened in 2001 as well and my citizen co-workers remember getting checks.
Does anyone who was on an H1B in 2001 remember getting a similar rebate check? I definitely dont remember getting one.

I am in the following situation.
1. I am going to complete my 6yrs of stay ( L1 period + H1 period) in USA by Dec 2008 (after adding my vacation time in India).
2. I got H1 valid till June 2010 and got stamped on passport that valid till June 2010.
( USCIS approved H1 for me till 2010 eventhou I complete 6yrs by end of 2008)
3. My LC was electronically filed in September 2007 in EB2 category in Chicago DOL. Got Audit in October 2007 on Business Necessity ground and was replied within due date.
4. After several months of waiting (Audit response was accepted), it was denied on the following reason. "The internal job posting was not as per the DOL regulations".
5. My Lawyer said, the notice that was submitted was in the proper format-the exact format specified by the regulations that applied for reconsideration
He also mentioned that, he filed LC for other candidates with same job posting and got approval on their cases.
6. Now, Atlanta is processing all permanent Labors. As there is a huge back log at Atlanta processing center, My lawyer suggested to apply a new application rather waiting on this reply.
7. we need wait another 2 months ( for job ads and wait for response ) before even we can apply for new LC. even we apply some time in September 2008. I should get an approval immediately (as I am going to complete 6 yrs) otherwise I will be in trouble.
Given the scenario, what are my options as I am on time crunch.....?
Any suggestions greatly appreciated.

2. Yes. You can retain the old PD with the I-140. Take care to note that that you are not applying for the PERM but your company will be and your company may or may not find qualified citizens/permanent residents. You do not and should not control the recruitment process.

The old I-140 is all valid. The only thing that you are taking is the date. When your new I-140 is approved and you interfile with I-485 then you request USCIS to take the new I-140 instead of the old one. Also if your new I-140 has problem at that stage (even after approval, some time it happens), still the old I-140 is valid.

I haven't had "any" FP yet, but I have my EAD and my advanced parole for tavel. I also have my H1B current and stamped in my passport.
Last time I got H1B stamped in the embassy, they took my fingerprits, 10 fingers (I also asked if they want the 10 toes :D)
Can that fingerprinting in the embassy be the reason why they haven't sent any notices for my fingerprinting?
Should I be worried?
Can somebody, please, tell me how do you ask for a service request?

I have just gone thru March recording of IV lawyer call and the below caught my attention. Ms Susan mentioned that any company name change after I140 approval has to refile I 140. I am utterly confused as that particular scenario affect me and i would like to know what best course of action i can take at this point.
I filed LC and I 140 with company A
My I 140 got approved
Before i filed my I 485 my company changed its name
I asked my attorney at that time if we need to take any special action
Attorney said they can just add an amendment while applying for I 485 about name change and apply with approved I 140, which is with old company name.
I and my wife work on EAD for past 3 years and i am still employed with same company. I wonder which one of above attorney is correct and what i should do.
Does the fact that my I485 is pending for more than 180 days after approval of my I 140 will come to rescue in case of question about company name change (AC21)

Don't be afraid of the "G" lenses. I have several "Pro G" lenses and they are fantastic. The only difference in the "G" lens is it does not have an aperture ring and you don't need that unless you are using the lens on a manual camera. You can set the aperture manually in your D70 through the camera settings and you just don't need the ring.
Nikon manufactures several different quality levels of lenses and the more the lens cost the better the quality. I suggest that you buy the best glass your budget will allow and you can upgrade later. That's what I did.
I have the Nikkor 70-300 f4-5.6D ED AF Zoom and for the money it's a good lens. It's a consumer lens and doesn't have the build quality of my Nikkor 70-200 F2.8G AF-S VR IF ED Pro lens. But it works just fine and doesn't cost any where near what a Pro lens cost.
